If you live in Colorado and consume marijuana, it’s important you know the law so that you don’t find yourself in a bad position. You can have up to 1 ounce of marijuana without being charged with a petty drug offense. If you have more than 1 ounce and less than 2 ounces, the police can charge you with petty drug possession. Learn about petty offenses and what happens when you face them, but you should also learn how a petty offense can become something much more.
Penalty for Drug Petty Offenses
If you have less than 2 ounces of marijuana, you face fines of up to $100. Consuming and selling two ounces or less are separate charges. For example, someone who consumes marijuana in public can be charged twice. If the police charge you with openly consuming marijuana, a judge can order you to complete 24 hours of community service for each offense.
Preventing the Situation From Getting Worse
Although a petty drug offense might not seem like a big deal, the situation can escalate if you are not careful. For example, the police might find additional items on you or in your vehicle and implement additional charges. You could also face additional DUI charges if you were operating a motor vehicle. In such cases, consulting a DUI lawyer could be crucial in navigating the complexities of the law and ensuring your rights are protected.
After you are charged, look at your ticket to ensure you know what is going on and what you should do next. During your interaction with law enforcement, don’t answer any questions. Many police officers will probe you with questions to discover other charges with which they can hit you.
Why You Need a Lawyer
Having a trained, caring, and qualified legal expert, such as a drug possession lawyer, on your side is vital. In some cases, the prosecutor might hit you with a higher offense than you committed to get you to accept a plea deal. In other cases, you could face an unfair number of charges that could lead to jail or prison.
No matter the situation, you can’t afford to take unneeded chances when your future is on the line. Understanding the differences between Colorado drug and alcohol DUIs is crucial, as each has its own set of consequences and defenses. The right Colorado drug defense attorney will have your back and point you in the right direction. Your lawyer helps you decide your odds of victory. Having the right legal expert on your side puts your worries to rest and gives you peace of mind.
